Basically long story short, I bought a new car in January from a main dealer on a finance deal, the car has been making a weird noise so I took it back a few times under warranty, the garage has come back and said they are going to change the whole engine. Initially I was shocked, but now I'm starting to think I should not be accepting the car back. It is a lot of work to do on a brand new car, and I am now paying for a finance car which is going to be in the garage for at least a month as the engine is on backorder, legally where do I stand?

i had this issue last year with a brand new car legaly you have to give them reasonable chance to repair the vehicle if they replace the engine and the problem persists then you would prob be able to reject but until then i doubt you will get any where i got rading standards etc involved and still they only had to repair vehicle or give me like for like which meant car same age mileage etc etc which meant second hand so i let the finaly repair as mine was 1 owner me if i swapped i would be 2nd owner

as long as they give yo an equal or better car to drive while they got yours dont worry but you must demand the equal loan vehicle

 

fight them it will cost you time and your hair go with them and all should be fine and you get a month less mileage on your motor also

 

ask for free next service or similar

Go for a free service

 

add a 1 year extended warranty policy (if you intend to keep the car past its warranty)

 

Else go for a free jacket or watch or something

 

These guys have a route whereby they can work this in as part of the warranty claim with the OEM

Many years ago when I worked for a Renault dealer, we had a customer with an oil leak on his Clio 172. Turned out to be from an oil gallery drilling on the cylinder head and required a new head. He rejected the car as a major component had failed, Renault gave him a brand new Clio 182. Not sure what the law says now but would ask trading standards where you stand. I think the rejection procedure only applies within the first six months, so as you brought in January it may not apply. Get in touch with the manufacturers customer service department and explain the problems you are experiencing and tell them you wish to reject the vehicle under the sale of goods act and see if they are willing to play ball, they may offer you a new car. I have filed a complaint and rejected the car with the manufacturer through the quality assurance team, they are now investigating and seeking advice from there head office, the grounds for the rejection is due to the whole power unit being replaced and my dispute with the quality. Also being factored in is the complete lack of customer service from the main dealer.
