Pre Sva, Mot

Check out this topic on Piston Heads.

It seems that if you take your kit for a pre SVA MOT inspection (pre-booked of course!) insured on the chassis number (as I, amongst others thought it was legal to do)

Then should it fail the MOT, or not be able to partake in the examination through some reason, it would then be illegal to drive it home on the road, and the insurance whould be null & void if you did.....................

 

I think we await expert advice please! :huh:

 

It's just been commented on by a BiB there, who agrees with what we originally thought. but.................??????

That's a nasty one reading between the lines the same will apply if you fail SVA so does that mean the only way to move your car prior to a pass is on a trailer?

Hi All

When my lad insured his Dax with MSM, they specifically stated, in writing, that it was insured to drive anywhere, there AND back, in pursuit of work to pass SVA. Whether the police would agree is another matter, but the insurance company, who specialise in kits etc., and know all aspects of this sort of thing, were quite happy with the arrangement.

Interestingly, while MSM were very helpful in arranging Dave's insurance, when he mentioned that I was coming up for need of cover soon, and would they like some more business, they said sorry, but they do not insure Robin Hoods. Very strange....

This is really open o interpretation. It's the corner stone of British justice - a policeman's discretion!

 

Anyway, my view would be that the fact thata pre arranged MOT is provable then it is irrelevant if it passes or fails. The fact is you presented for test purposes. Providing you don't take the p**s and drive a route to and fro equal to the length of the M25 then that would be OK. The same applies for SVA.

 

The issue around 'no MOT no insurance' does not necessarily follow. It is up to the insurance company to refuse cover based on the circumstances, it is not a statutory conclusion. I would expect any insurance company who are in possession of the facts and issued a cover note based on ehe chassis number to honour that contract as long as you have complied with the law.

Interesting. I wonder if, now that the cops can check via DVLA the tax, insurance and when fully implemented the electronic MOT, this sort of reinterpretation of the rules will happen more often. It has always been the case that you could drive home from a mandatory MOT to rectify a fault unless the MOT inspector decided the car was unsafe to drive.There has been no new legislation changing this as far as I know. Surely an overzealous copper making an unjustified new interpretation of the rules.

Not sure how this affects kits driving to MOT, pre SVA if this is not a statutory requirement.

The point is over zealousness cannot result in a conviction. Any report for summons made is scrutinised in a prosecutions unit where anonomlies are picked up.
