The definition of theft:

To dishonestly appropriate property belonging to another with the intention to permenantly deprive the other of it.

Thus; are you intending to permenantly deprive and is your appropriation dishonest?

Sadly though, property has to have some level of tangibility, that being "to hold" or something that has a level of realness. A computerised image or any other electronic communication technically cannot be held as in it's usual form it is inside the computer as code. Once it has been printed or downloaded to disc or other capture device it is then tangible, however, under the computer misuse act, images and text can be classed as property before this, and therefore can be stolen.

If the gifs are put onto a site that openly allows downloads, then that is fine.

WHAT AM I DOING ALL THIS FOR? WE JUST WANT GIFS OF BOUNCING WANGERS!!!!!!!! :yahoo: :yahoo: :yahoo: :yahoo:

Back to the point in hand, if it is on offer and is stated for free usage, then that is fine. Albeit being civil law, I believe that Copyright has to be stated? Otherwise how the hell would you track down the originator/owner?
